The Assembly of the Republic decrees, pursuant to articles 164, d), 168 (1) (f) and 169 (3) of the Constitution, the following:

Base I
 
General principles
 
1 - The protection of health is a right of individuals and the community that is effective in the joint responsibility of citizens, society and the State, in freedom to demand and provide care, in accordance with the Constitution and the law.
 
2 - The State promotes and guarantees the access of all citizens to health care within the limits of available human, technical and financial resources.
 
3 - The promotion and defense of public health are carried out through the activity of the State and other public entities, and civil society organizations may be associated with that activity.
 
4 - Health care is provided by state services and establishments or, under the supervision of the latter, by other public entities or by private entities, whether or not for profit.

1 - Health policy is national in scope and follows the following guidelines:

3 - In relation to minors and incapacitated persons, the law shall provide for the conditions under which their legal representatives may exercise their rights, in particular the right to refuse assistance, in accordance with the constitutionally defined principles.
